Warranty

The responsibility to read and understand the manufacturer’s terms and conditions of warranty or the extended warranty (if any) lies with the Buyer. The manufacturer’s warranties shall be incorporated by reference into these Terms.
The buyer acknowledges that the warranty covers manufacturing defects when recognized by the manufacturer’s workshops only. The warranty does not include defects resulting from the Buyer’s misuse of vehicle or subsequent repairs by a workshop operated by a party other than the manufacturer. Failure to abide by the terms and conditions of the warranty will result in the cancellation of the warranty, in which case the Buyer shall not have the right to ask for a replacement vehicle or reclaim the purchase price.
The Buyer acknowledges and agrees that he has no right to claim from Shineray Qatar for any defect in the vehicle discovered after delivery of the vehicle to the Buyer that is not covered by the warranty terms and conditions and extended warranty terms and conditions (if any) applicable on the vehicle.
Any warranty for the vehicle shall commence on the date of the purchasing invoice from Shineray Qatar to the buyer.

Vehicle Delivery

Unless otherwise agreed in writing, delivery of the vehicle shall take place at the Shineray Qatar facility specified by the Buyer on, and as per the agreed date that Cleary mentioned in the sales agreement. The point of delivery shall be one of Shineray Qatar showrooms in the State of Qatar as agreed by Shineray Qatar and the Buyer. The Buyer shall make all arrangements necessary to take delivery of the vehicle.
Delivery of the vehicle to the Buyer shall only occur after the Buyer has appeared at the agreed-upon Shineray Qatar facility, signed a physical copy of the sales contract and presented Shineray Qatar with his ID, proof of address, and any additional documentation as requested by Shineray Qatar. For the avoidance of doubt, a Buyer must appear at Shineray Qatar facility to sign a sales contract and present the documentation requested by the dealer.
Shineray Qatar shall not be held liable for any delay in delivering the vehicle title caused by procedures of the Traffic Police Department.
Ownership of a vehicle shall not be transferred to the Buyer until the purchase price has been paid in full by the Buyer plus transportation and traffic police fees.
Upon physical delivery of the vehicle to the Buyer, Shineray Qatar shall be released from all liability towards the Buyer in relation to the vehicle, and all responsibilities and risks associated after date and time of physical delivery will be the responsibility of the Buyer, except to the extent of any warranty purchased from Shineray Qatar applicable on the vehicle, in accordance with the terms and conditions of such warranty.
The Buyer commits to use the vehicle in accordance with applicable law. From the time of delivery, the Buyer is solely responsible for any use of the vehicle which results in a violation of any applicable law.
Should Shineray Qatar become aware of any circumstance that would render the sale of the vehicle to the Buyer in violation of any applicable law, including but not limited to the terms and conditions of the manufacturer, at any time during the period commencing on Shineray Qatar receipt of the down payment and prior to completion of the sale process, Shineray Qatar shall be entitled to terminate the sale process and any related contract(s) and reimburse to the Buyer any payments made to Shineray Qatar by the Buyer for the vehicle, less any costs incurred by Shineray Qatar.
The Buyer hereby agrees to unconditionally and irrevocably release and forever discharge Shineray Qatar from all claims, charges, complaints, actions, causes of action, defenses, demands, suits, representations, covenants or otherwise, relating to any matter, claim or right, which the Buyer has or may have against Shineray Qatar arising out of or in connection with the cancellation of the sale process in this regard.

Obligations of Shineray Qatar

Shineray Qatar shall comply with applicable laws and regulations, including the following:

It shall possess the vehicle in compliance with applicable laws, possess the necessary documents to register it in the name of Buyer, and maintain the vehicle until the time of physical delivery to the Buyer.
It shall abide by the representations and warranties set out herein towards the Buyer, in addition to the provisions of the Commercial Agencies Law
It shall deliver the vehicle to the Buyer at the time indicated herein subject to the terms and conditions hereof, free from any damage; notify the Buyer, in writing, of any damage that may have been caused to the vehicle during the pre-delivery period; and obtain the Buyer’s written approval in such circumstance.

Obligations of the Buyer

The Buyer shall comply with all applicable laws and regulations, including the following:

It shall review the manufacturer’s warranty manual, and any document maintained within the vehicle and abide by the provisions contained therein.
The Buyer shall review the terms of any additional service agreed upon, if any, and abide by its terms.

Consent to Usage and Processing of Personal Data

By using this website, you hereby acknowledge and agree that Shineray Qatar , in its capacity as data controller, will process your personal data in compliance with applicable laws.
The personal data you provide to Shineray Qatar will be processed for the following purposes:
1. For contractual purposes as to execute sales or services agreements or the vehicle manufacturer’s warranty obligations in the event you purchase a vehicle; and/or
2. Subject to your express consent, to provide you with sales and/or promotional information about new products and for market research and surveys.
Your personal data will be processed for the purposes specified above using both automated and non-automated tools, in accordance with the principles of confidentiality and security measures prescribed by applicable law.
You hereby acknowledge and agree that:
1. You are providing your personal data to be processed by Shineray Qatar for the purposes specified in clause 7.2 above; and
2. Shineray Qatar may disclose your personal data if required to do so:
  1. by applicable laws.
  2. at the request of any governmental authority.
  3. at the request of the vehicle manufacturer.
  4. in the good faith belief that such action is necessary.
  5. to comply with a legal obligation.
  6. to protect and defend the rights or property of Shineray Qatar
  7. to protect Shineray Qatar against legal liability.

Intellectual Property

The intellectual property rights in all software and content made available to you on or through this Website remains the property of Shineray Qatar or the property of our licensors. The software and content are protected by copyright laws and treaties around the world.
You may access, use, store, print and display content on this Website solely for your own personal use. You agree not to copy, reproduce, republish, upload, post, “deep link,” “embed,” or otherwise transmit or distribute the contents of this Website or use such contents in connection with any business or commercial enterprise.

Assignment and Sub-Contracting

The Buyer may, at its discretion and after completing the necessary forms of Shineray Qatar , assign the registration and receipt of a vehicle to a third party or a corporate entity after full payment of the purchase price of the vehicle, or authorize a third party to take physical delivery of the vehicle on the Buyer’s behalf.
Shineray Qatar may assign any or all its rights under these Terms to any entity affiliated with Shineray Qatar.

Waiver

The failure by either party to enforce at any time or for any period any one or more of the Terms herein shall not be a waiver of them or of their right at any time subsequently to enforce any of the Terms.

Severability

If any term or provision of these Terms is held invalid, illegal, or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions herein shall continue in full force and effect as if these Terms had been agreed with the invalid, illegal or unenforceable provision eliminated.

Limitation of Liability

Subject to the Terms, the maximum amount of liability of Shineray Qatar for any loss or damage arising from the transactions contemplated by the Terms will not exceed the contract price in relation to the purchase of a vehicle by the relevant Buyer.

Indemnity

You agree to defend, indemnify and hold us, our directors, agents, affiliates, licensors and suppliers harmless from and against any and all claims, damages, costs and expenses, including legal fees, arising from or related to your use of the Website and/or your breach of any representation, warranty, or other provision of the Terms, including the use by third parties accessing the Website using your account caused by your action or inaction.

No Agency

Nothing contained in these Terms shall be construed as creating any agency, partnership, or other form of joint enterprise between you and Shineray Qatar .

Entire Agreement

You acknowledge and agree that these Terms constitute the complete and exclusive agreement between you and Shineray Qatar concerning your use of the Website and any purchase by you of any items through the Website, and supersede and govern all prior proposals, agreements, or other communications.

Governing Law and Dispute Resolution

Shineray Qatar is domiciled in the State of Qatar and these Terms shall be governed according to the laws of the State of Qatar.
In the event of a dispute arising from these Terms, you agree to cooperate with Shineray Qatar to resolve such dispute through good-faith negotiations. In the event such negotiations fail, you agree that such dispute shall be resolved by any court of competent jurisdiction in the State of Qatar.

Running-in maintenance of new vehicle
The first maintenance for a new vehicle is performed after 2,000±500 km of driving or 3 months after the purchase of the vehicle (whichever comes first).
Routine maintenance
According to the “User’s Manual”, after the running-in maintenance, the vehicle in principle should be maintained every 5,000 km or every 6 months (whichever comes first) in accordance with the specified maintenance items, time and mileage. See the “List of maintenance items” in the “User’s Manual” for details.
Maintenance contents
If your vehicle is used under severe conditions, routine maintenance should be performed at intervals of 3000±500km or 90±5 days of driving (whichever comes first) after the first maintenance, with the same maintenance items as for normal environmental use.

“Severe conditions” include:
1. The vehicle is often driven in dusty areas or is frequently exposed to salt-laden air.
2. The vehicle engine is constantly idling or the vehicle is often driven in congested road conditions.
3. The vehicle is often driven on uneven, waterlogged roads or mountain roads.
4. The vehicle is often driven in cold areas. During the cold season, the vehicle engine runs at idle speed for long periods of time or the vehicle is often driven on short trips.
5. The vehicle is subject to frequent braking or emergency braking.
6. The vehicle is often used to tow other vehicles.
7. The vehicle is used as a cab or rental car.
8. The vehicle is driven slowly for more than 50% of the total driving time in high temperatures above 32°C or in congested urban areas.
9. The vehicle is driven in an overloaded condition.

Running-in maintenance of new vehicle
The first maintenance for a new vehicle is performed after 3,000±500 km of driving or 3 months after the purchase of the vehicle (whichever comes first).
Routine maintenance
According to the “User’s Manual”, after the running-in maintenance, the vehicle in principle should be maintained every 10000 km or every 6 months (whichever comes first) in accordance with the specified maintenance items, time and mileage. See the “List of maintenance items” in the “User’s Manual” for details.
The maintenance interval of the vehicle used in severe conditions should be shortened, the interval of regular maintenance should be 5,000 km or 3 months

Severe conditions include one of the following conditions:
1. The vehicle is often driven in dusty environments
2. The vehicle is subject to frequent braking or is often mountainous areas
3. The vehicle is often used to tow a trailer or wagon
4. The vehicle is often driven in watery areas
5. The vehicle is often driven in high humidity areas or mountainous areas
6. The vehicle is often driven in areas rich in salt or other corrosive substances
7. The vehicle is often driven on rough and muddy pavements or in the desert
8. The vehicle is often driven with cargo

Basic warrant excludes:
1. Tires (its warranty is valid with tires agent)
2. Damages related to natural disasters
3. Modifications to the vehicle contrary to manufacturer’s recommendations
4. Traffic accidents and collisions
5. Repair or modification of any part of the vehicle using unoriginal spare parts
Disputes: If a dispute arises between the Company and customer, it shall be referred to the competent authorities.

WARRANTY TERMS & POLICIES

All SHINERAY LIGHT COMMERCIAL VEHICLE ARE :
3 years Warranty or 100,000 KM when even comes first.
